
Algorithm Accountability: Who Owns the AI Governance Crisis?
It’s a classic Tuesday morning in the city. Your firm has just deployed a state-of-the-art Large Language Model (LLM) to automate customer triage. By Wednesday, the bot is inadvertently hallucinating a “100% refund policy” for every disgruntled customer in Leeds.
The board wants heads to roll. They turn to the CTO, who points to the Data Science lead. Who points to the third-party vendor in San Francisco. Finally, the Legal team gets pointed at for signing off on the Terms of Service. Legal, naturally, points back to IT for “failing to implement the right guardrails.”
Welcome to the “Moral Crumple Zone.” In the race to deploy AI, we’ve inadvertently created a world where everyone is involved, but nobody is responsible. As we move through 2026, the question of algorithm accountability has shifted.
From a philosophical debate to a high-stakes corporate liability crisis.
The diffusion of responsibility: Why nobody is “the owner?”
In traditional software, ownership is linear. If the database crashes, DevOps fixes it. If the UI is broken, Frontend owns it. But AI isn’t built; it’s grown, trained, and fine-tuned across a fragmented global supply chain.
This creates what sociologists call accountability diffusion. In a UK context, this is exacerbated by our “sector-led” regulatory approach. Unlike the EU’s omnibus AI Act, the UK relies on a patchwork of existing regulators, the ICO, the FCA, and the CMA, to interpret five high-level principles: safety, transparency, fairness, accountability, and redress.
When responsibility is spread this thinly, “governance blind spots” aren’t just a risk; they are a structural certainty. We see four distinct silos where ownership goes to die:
- The IT/engineering silo: Views the algorithm as a technical asset. Their metric is “uptime” and “latency,” not “ethical impact.”
- The business/product silo: Driven by ROI and “speed to market.” They see AI as a productivity lever, often treating the model as a “black box” that “just works.”
- The legal & compliance silo: Focuses on UK GDPR and the Data Protection Act 2018. They ensure the data input is legal, but they often lack the technical depth to audit the output logic.
- The data science silo: Focused on model weights, hyperparameters, and F1 scores. They understand the “how,” but rarely the “should.”
The governance blind spot: A British case study
In November 2025, the High Court of England and Wales handed down its highly anticipated judgment in Getty Images v. Stability AI. This was a watershed moment for the tech sector, clarifying for the first time that AI model weights, the numerical parameters that define a model’s intelligence, do not store or reproduce copyright works.
The Court ruled that the model itself is not an “infringing copy.” While this provided immediate comfort to AI developers, it inadvertently widened the gap in algorithmic accountability for the business units that actually deploy these tools.
By rejecting the idea that the model is a static “repository” of its training data, the ruling shifts the legal focus from the tool’s creation to the outputs it generates in use.

The “Moral crumple zone” in practice
If a UK bank uses an AI-driven credit scoring system that systematically discriminates against a specific postcode, who is the “controller”?
Under the UK GDPR (Article 22), individuals have a right to a human explanation for automated decisions. However, if the IT department can’t explain the “black box” and the business unit says they only “bought the service,” the firm finds itself in a “governance blind spot.”
The burden of proof has effectively shifted. Following the logic of recent UK discrimination and IP cases, when an AI output is challenged, the deployer, not the developer, often bears the burden of proving that no unlawful bias or infringement occurred.
For a techie, this means that “buying” an AI solution is no longer a way to “outsource” risk—it is the moment you inherit it.

Solving the “many hands” problem through algorithm accountability
To fix this, UK firms are moving away from the “Human in the Loop” (HITL) model, which often leads to automation bias, toward a “Human in Power” framework. This involves three strategic shifts:
- Unified AI command centres: Stop treating AI as an IT project. Leading UK firms are establishing cross-functional AI Ethics Boards. These aren’t just talking shops; they have the power to “kill” a model if it fails an ethical audit, regardless of the projected ROI.
- Algorithmic Impact Assessments (AIAs): Similar to a DPIA (Data Protection Impact Assessment), an AIA forces all four silos to sign off on a single document. IT documents the architecture, Business defines the use case, and Legal assesses the risk of bias. This creates a “paper trail of intent” that is vital when the ICO comes knocking.
- The “service level agreement” for ethics: When procuring AI, “ownership” must be defined in the contract. If you’re using a foundation model from a “Big Tech” firm, your legal team needs to negotiate clear indemnities for bias or hallucination-led damages. You cannot outsource your accountability, but you can certainly share the liability.
The AI governance alignment checklist (UK & EU)
- Classification & jurisdiction: Determine whether the system falls under “High-Risk” categories under the EU AI Act or under specific UK sectoral regulations (FCA/ICO/Ofcom), and appoint a single Senior Responsible Owner (SRO) who is legally accountable.
- Technical transparency: Document the complete data provenance and model versioning to ensure that every algorithmic decision is traceable back to its training source and specific logic weights.
- Bias & fairness control: Implement mandatory testing for protected characteristics and establish an automated “drift alert” system to notify the owner the moment the model’s output begins to skew or lose accuracy.
- Human sovereignty: Ensure the existence of a manual “Kill Switch” and a public-facing redress mechanism that allows any user to bypass the algorithm and appeal directly to a human decision-maker.
- Contractual liability: Audit all third-party SaaS contracts to ensure clear indemnity clauses are in place for intellectual property infringement or discriminatory outcomes caused by the vendor’s model.

The truth is nobody “owns” an algorithm in the way we own a laptop. An algorithm is a process, not a product. Therefore, ownership must be procedural.
The “Owner” isn’t the person who wrote the code; it’s the person who defines the objective function. If you tell an AI to “maximise profit at all costs,” you own the consequences of those costs—whether they are regulatory fines or a shredded brand reputation.
Blind spots in AI governance often occur at handoffs between departments. By closing these gaps with rigorous algorithm accountability frameworks, we stop the “blame game” before the first line of code is ever deployed.
